Appellate Court Orders Re-trial of 2010 Lawsuit Due to Missing Stenographer

The Appellate Court has ordered a re-trial of a lawsuit filed in 2010 and finalized in the first instance in 2017, due to the disappearance of the stenographer who recorded the trial proceedings. The stenographer had retired in October 2021 without completing the transcription of the minutes from specific dates. The Appellate Court judges ruled that the absence of the minutes makes it impossible to properly hear the appeal and ensure a fair trial. The decision states that a re-trial is the only legally correct solution, despite the inconvenience it will cause to the parties involved. The court also decided that the costs of the re-trial will be borne by the Republic of Cyprus, as the parties bear no responsibility for the loss of the minutes.
