Justification for Christos Triantafyllidis: His Exclusion from RIK Due to DISY Was Illegal

The Administrative Court ruled in favor of lawyer Christos Triantafyllidis, overturning the decision of the Cyprus Broadcasting Corporation (RIK) to exclude him from a tender for the award of legal services in 2020. RIK had rejected Triantafyllidis' offer, which was the lowest, citing a conflict of interest due to his position as President of the Legal Council of DISY. The Court ruled that Triantafyllidis' position as a legal advisor to a political party does not automatically constitute a conflict of interest in a tender for the award of legal services to an external partner. RIK's decision was characterized as a product of a misinterpretation of the tender terms and flawed reasoning. The case concerns a RIK tender for the award of legal services, in which Triantafyllidis had submitted the lowest bid. Despite the recommendation of the relevant committees, the then RIK Board of Directors decided not to award him the contract due to his connection with DISY. The justification of Triantafyllidis highlights the importance of objectivity and legality in public procurement procedures, as well as the need to avoid unjustified exclusion of candidates based on political criteria.
